Moldovan women maintained by insured husband to have to sign declaration to benefit from maternity allowance

Chisinau, 12 October /MOLDPRES/ - Women who are maintained by the insured husband and will benefit from maternity allowance will have to sign a declaration on her own responsibility before receiving the payment, according to a government decision due to be published in the 13 October issue of the Official Journal (Monitorul Oficial).   

By the signing of this document, the woman is to confirm that, on the date of providing the maternity leave she is not employed, does not benefit from an insured income and is not a person insured by the concerned risk.

At the same time, if it is proved that the information declared by the beneficiary is not truthful, the woman will be obliged to return the sum of the maternity allowance received.  

In last June, the cabinet approved a decision, which sees that the wife maintained by the insured husband will benefit by maternity allowance.

The decision was approved after, on 9 February 2017, the Constitutional Court had declared unconstitutional the Article 16, paragraph 5 of the Law on allowance for incapacity for work. The law saw that “the wife is maintained by the insured husband if, during nine consecutive months before the month of providing the maternity leave, she was not employed or does not have an income equivalent to four monthly salaries or if she lost the status of insured person.” 

According to a report presented by the National Social Insurances House, the expenses needed to implement this draft law are estimated at 182 million lei in 2017, more than 200 million lei in 2018 and about 218 million lei in 2019.
