Moldovan judges having serious disciplinary infringements to be dismissed from office

Chisinau, 21 June /MOLDPRES/ - The legislation on disciplinary liability of judges will be amended in line with recommendations by the Venice Commission. A draft law to this end today was passed in the first reading with the votes of most MPs present at the plenary meeting.   

Following the amendments made to the legislation, only the “serious or repeated” disciplinary infringement will represent ground for the judge’s dismissal from position.

At the same time, the new legal provisions contain clear-cut terms on the facts which can be described as disciplinary infringements.

The adoption of a court ruling, through which the rights and freedoms of private people or legal entities, guaranteed by the Constitution and the international treaties Moldova is party to, were violated deliberately or out of serious negligence, will be regarded as disciplinary infringement. Another amendment sees that disciplinary infringement is also the non-fulfillment or improper fulfillment of a job duty, without a reasonable justification and which directly affected the rights of the participants in the action at law or of other people.     

Other amendments establish that the disciplinary procedures can be started also against judges who resigned, for deeds committed during the mandate of judge.   

The draft is to be voted in the final reading.
