Moldova to have Administrative Code

Chisinau, 19 July /MOLDPRES/ - Moldova will have an Administrative Code which will define the way the institutions and authorities of public administration work. The parliament adopted the document in the final reading today.  

The new Code is aimed at systematizing all legal regulations on the administrative procedure and administrative disputed matters in a single act. The new regulations determine the field of enforcement of the administrative procedure, way the procedure is carried out, administrative operations, contracts, fulfillment and observance of the administrative acts, control and ways of appeal, etc.  

Thus, the Code will regulate the issuance of administrative documents by the public authorities, mechanisms of settling petitions submitted by citizens and will comprise all the legislative acts which presently establish the legal relations of administrative law.   

The refusal to receive or consider an application will be regulated for the first time ever. Also, the compulsoriness of compilation of the administrative file by public authorities will be instructed for the first time ever too. Likewise, the possibility to conclude the contract on conciliation between sides, both in non–contentious proceedings and in the contentious ones, will be established.   

According to the authors, the document is meant to clear up the principles, concepts, stages of the administrative procedure, ways of appeal and the legal regime of acts, administrative operations and contracts, in order to ensure the observance of the rights and freedoms, provided for in the law, of private persons and legal entities, taking into account the public interest and the rule of law state.  

Moldova’s Administrative Code is to enter into force on 1 April 2019.
