Notary office to be able to make removal of marriage in Moldova

Chisinau, 27 September /MOLDPRES/ – The removal of marriage, throughout consent of spouses, could be made to the notary. A draft law that will offer these powers to notaries was voted today in the first reading by the majority of MPs present at the plenary session.
According to the project, the request for marriage may be submitted to any notary based on the joint consent of the spouses and in their presence. The application shall be made in writing, following a model approved by the Ministry of Justice (MJ).
The marriage disclosure document should address, where appropriate, the way parents are involved in education, maintenance of joint children, establishing their domicile, paying the pension of husband or dividing the common wealth acquired during the marriage.
At the time of filing the application, the notary will grant the spouses a period of 30 days for the eventual withdrawal of the marriage request. Upon expiration of the term, the notary shall issue the marriage annulment by agreement of the parties and within three days transmit it to the territorial civil status body.
Also, the draft establishes that notaries will be able to reject marriage applications if one of the spouses can not express their free and unintentional consent or if the application is not signed by both spouses.
