Notaries to be able to undo marriages

Chisinau, 31 January /MOLDPRES/- The promulgation decree and the law on notary procedure, which states that notaries will be able to divorce marriages by consent of the spouses, will be published tomorrow in the Official Journal of Moldova.

Under the new amendments to the legislation, the application for dissolution of marriage by consent of the spouses can be submitted to any notary based on the common agreement of the spouses and in their presence. The application shall be made in writing, following the model approved by the Ministry of Justice.

When registering the application, the notary will give the spouses, according to the Family Code, a period of 30 days for any withdrawal of the application. The deadline for withdrawing the application may be extended by up to 30 days. Upon expiry, the notary shall issue a conclusion on marriage dissolution by mutual consent and within three days will send it to the territorial civil status body for registration.
