Chisinau, 25 September /MOLDPRES/- The Constitutional Court / CCM / has recognized as the contribution period necessary for the exercise of the right to retirement, the period of care of the person with severe disability, regardless of age.

The notification on the matter was submitted to the CCM by Ombudsman Mihail Cotorobai. He said that the provisions subject to constitutional control set discriminatory treatment between the parent, guardian of a child with severe disability and the parent, guardian of a person with severe disability aged over 18, in terms of pensions.

The court found that the solution of declaring the text unconstitutional "of a child with severe disabilities under the age of 18" from Article 5 (2) lit. d) of Law no. 156 of October 14, 1998, the right to a pension would be ineffective in the case of the person caring for a severely disabled person and would create blockages within the public pension system. For these reasons, in order to remedy the existing deficiency, the Court reserved its prerogative to establish a solution until Parliament intervened.

This decision is final, cannot be subject to any appeal, enters into force upon adoption and shall be published in the Official Journal of the Republic of Moldova.
