Law on lawyer's profession might be amended in Moldova

Chisinau, 3 March /MOLDPRES/ - The parliament’s juridical commission for rules and immunities today gave a positive note to the report on a draft on amendment and completion of the law on lawyer’s profession.   

The new amendments regard the trainee lawyer and the procedure of carrying out the professional probation in the sector. The initiative’s authors, MPs of the Party of Socialists (PSRM) say that the amendments will enhance the efficiency of the professional probation carried out and the acquiring of practical skills in the specific activity field, as the trainee lawyer has right to assist the guiding lawyer at any phase of the lawsuit, criminal trial and contravention suit.   

The draft provides for the giving of a legal term to the trainee lawyer, to get knowledge and practical skill in the field of providing legal assistance in terms of criminal law, comparative criminal procedure and civil law.   

The new completions include also the establishment of an efficient premise for enhancing the correctness and transparency of the process of acceding to the profession of lawyer and namely the setting up of a commission for solving appeals, which will re-examine the results of the exams on admission to the probation and the qualification exams, for each stage. Another amendment proposed is the establishing of the rules of advertising and communication of the acts issued by the bodies of self-administration of the profession of lawyer; the way of publishing the acts and information on the webpage of the Lawyers’ Union was chosen, at a column dedicated to the Union’s recent acts; also the way and terms of appealing the administrative acts were established.  

Following the adoption of the concerned draft, decision-makers will have to amend the normative acts of the Moldovan Lawyer’s Union, as well as to adopt new normative acts on the fields of activity developed through the regulations of the draft law promoted.
