Moldovan MPs propose to set up mechanism for verifying, sanctioning Prosecutor General

Chisinau, 12 August /MOLDPRES/- MPs propose to set up a mechanism to verify activity of the Prosecutor General, as well as to sanction him, after conducting a performance evaluation.

At today's meeting, the committee on rules and immunities unanimously approved the report on the draft amendment to the Law on Prosecutor's Office.

According to the document, to assess the activity, level of knowledge and professional skills, correspondence with the position held, the performance of the Prosecutor General will be evaluated annually by the performance evaluation commission of the Prosecutor General, set up by the Superior Council of Prosecutors.

The evaluation of the General Prosecutor's performance may be initiated upon notification of the President of the Republic of Moldova or at least three members of the Superior Council of Prosecutors. The performance evaluation commission of the Prosecutor General will consist of five members, one of whom is proposed by the President of the country, one by the Ministry of Justice, one by the Superior Council of Magistracy, one by the Superior Council of Prosecutors and one by the Prosecutor General.

"In case of obtaining the qualification" failed ", the Superior Council of Prosecutors proposes to the President of the Republic the dismissal of the Prosecutor General", it is shown in the informative note. Likewise, the position of member of the performance evaluation commission of the General Prosecutor may be held by persons with qualifications in the field of law, public management, having at least 10 years of experience in the field of professional activity and an impeccable reputation. The members of the performance evaluation commission of the Prosecutor General proposed by the President of the Republic and the Ministry of Justice may not be employed in the public service.

In addition, it is proposed to regulate the possibility of suspending the Prosecutor General from office if a criminal investigation has been initiated against him. 

President of the country at the proposal of the Superior Council of Prosecutors appoints an interim General Prosecutor during the period of suspension.
