Amendments to legislation on functioning ANI approved in first reading

Chisinau, 13 August /MOLDPRES/- The Parliament approved, in today's plenary session, with the vote of the majority of deputies, the draft law amending the Law on the National Integrity Authority and the Law on the declaration of wealth and personal interests, in the first reading. The project was drafted by a group of MPs from the Action and Solidarity Party and aims to improve the legislative framework on the functioning of ANI and prevent conflicts of interest and incompatibility among people holding public office or public dignity .

One of the regulations of the law is the elaboration of the mechanism that allows the Public Integrity Authority to request the management of the public organization or the authorities responsible for appointing the subject of the declaration the possibility of suspension from office of persons in respect of whom a total or partial unjustified wealth or in the event of a breach of the legal regime of conflicts of interest, incompatibilities, restrictions and limitations, during the examination of the finding in court.

The document also aims to change the way in which the control of wealth and personal interests takes place, so that in the process of carrying out the control to verify not only the income acquired during the exercise of the mandate or function, related to the situation of assets held, but to be examined and taken into account. consideration and expenses incurred.

Another change proposed by the authors of the legislative initiative is to grant the integrity inspector the right to request the performance of expert assessments or assessments to determine the market value of the goods subject to verification. The respective modification will impel the subject of the declaration to specify the real value of the declared goods. And if the integrity inspector has reasonable doubts about declaring a good below its real value, he will have the possibility to order an assessment.

Provision is made for the creation of the Electronic Register of persons who have been suspended or terminated from office, employment or service relations in connection with the violation of the legal regime of declaration of assets and personal interests or the legal regime of conflicts of interest, incompatibilities , restrictions and limitations, as well as the Electronic Register of confiscated goods for non-compliance with the legal regime of the declaration of property and personal interests.

The provisions of the project propose that the control of wealth and personal interests be extended to the spouse, parents / in-laws and children of the person subject to control. If the person subject to the control is in cohabitation or if he has dependents, the verification will be extended to the assets of these persons.

The draft law also proposes to increase the number of members of the Integrity Council. Thus, Parliament is to appoint two members to the Council instead of one. The President of the Republic of Moldova would also appoint a member of the Integrity Council.

According to the head of the parliamentary committee on rules and immunities, Olesea Stamate, the approval of these legislative norms is among the conditionalities of the European Union for the disbursement of the second tranche of financial assistance for our country.
