Chisinau, 16 September /MOLDPRES/- Acting head of the Supreme Court of Justice and deputy head of the institution will be appointed by the Superior Council of Magistracy. A draft law in this regard was voted in first reading today.
According to the draft, if the position of president of the Supreme Court of Justice is vacant, interim will be provided by a judge appointed by the CSM.
Acting head of the Supreme Court of Justice was appointed on the basis of age. Under the circumstances, the authors of the draft think that age, as the only eligibility criterion for the ex-jure assignment of interim capacity in the exercise of administrative duties in the CSJ is a defective removal of the CSM from the exercise of statutory duties.
