Constitutional Court declared appeal of Superior Council of Magistracy as inadmissible

Chisinau, 20 September /MOLDPRES/-Constitutional judges declared inadmissible the appeal filed by the Superior Council of Magistracy on declaration as unconstitutional of the law that involves raising the retirement age for judges, starting on 1 July 2021.

Based on the examination of the notification submitted by the Superior Council of Magistracy, the judges of the Constitutional Court found today that the notification is inadmissible and cannot be accepted for substantive examination.

„It is declared inadmissible the notification regarding the control of the constitutionality of the provisions of article 32 of Law no. 544 of July 20, 1995 regarding the status of the judge (in the wording of Law no. 222 of December 4, 2020), submitted by the Superior Council of Magistracy ”, the decision of the Constitutional Court reads.

According to the article of the law in question, starting with July 1, 2021, the retirement age is set for judges of 50 years and 6 months, for both men and women. Each subsequent year, the retirement age is increased until the age of 63.

The Superior Council of Magistracy argued that the contested provisions significantly diminish the social guarantees of judges.
