Moldovan government approves more amendments to Contravention Code

Chisinau, 12 January /MOLDPRES/ - Moldova’s Contravention Code will be amended and completed with new provisions, the goal of which is to counteract phenomena which lead to the infringement of the public order and security, pollution of the environment, attempting against the constitutional rights of private people and the residents’ health. The cabinet today approved a draft law to this effect, the government’s communication and protocol department has reported.   

Among the most important changes, there is a proposal to extend the time interval when reconstruction works, accompanied by noise in blocks of flats, are not allowed. While so far, the repair works have been banned starting from 18:00 till 8 am, according to the new provisions, they will be forbidden on Sundays too. ‘’These provisions have to goal to make more responsible people when observing the public peace, observing the right to private life, cultivating a spirit of mutual respect between neighbours of blocks of flats,’’ Justice Minister Sergiu Litvinenco said at the cabinet meeting.   

Another modification suggested for the Contravention Code deals with the inclusion of punishment for begging accompanied by the simulation of a disability. More exactly, the person due to simulate a physical or psychic disability by appealing to people’s compassion, asking for material help, will be punished with fine from 6 to 30 conventional units (from 300 to 1,500 lei) or non-remunerated labour for the benefit of the community from 20 to 60 hours.    

Also, decision-makers propose to complete the Contravention Code with a stipulation which gives prosecutor possibility to verify the lawfulness of the actions of the official examiner from the subdivisions of the Interior Ministry (MAI), National Anticorruption Centre or of the Customs Service at the registration of notifications about the committing of contraventions. Following the verification carried out, as case may be, the prosecutor will be able to start the contraventional suit or will appeal the decision by the official examiner in court.   

Also, taking into account the ever larger number of contraventional suits pending in courts and the short term of examination existing at present, decision-makers propose to extend the maximal term of examination from 30 days to 2 months starting the moment of the file’s entrance in court.   

The draft law suggests also the adjusting of the provisions of the Contravention Code in the part dealing with the possibility to pay a half of the fine established, if the person pays in three days at the most after the date when the decision on imposing the contravention sanction is brought to knowledge.

Also, proceeding from the fact that, in the last years, the processes of degradation of the fertile soil have been boosted, including because of the human factor, decision-makers propose to complete the Contravention Code with new sanctions. Thus, private people will be sanctioned with fine worth from 4,000 to 7,500 lei and legal entities – from 5,000 to 15,000 lei for the unauthorized depositing of construction materials or waste of extractive industry and other things of this kind on grounds with fertile soil.   

At the same time, the draft law proposes tougher sanctions for the infringement of the rules on the organization and book-keeping, compilation and presentation of financial situations or reports. The fines will reach 100 conventional units (5,000 lei) for certain infringements of the legal provisions.   

The draft law is to be submitted to parliament for consideration and approval.
