Moldova's Commission for Emergency Situations approve new decisions in context of emergency situation

Chisinau, 2 March /MOLDPRES/ - The members of the Commission for Emergency Situations (CSE) today decided to establish measures specific in the justice sector on the period of the emergency state. Thus, the consideration by courts of civil causes, actions in administrative court was suspended de jure, the government’s communication and protocol department has reported.   

Exception represents the civil cases:  

-    on the issuance of protection ordinances;  

-    on the taking in public custody of foreigners and of prolonging its duration;    

-    on the confiscation of the unjustified wealth for the use of the state;  

-    on the agreement of forcible hospitalization and forcible treatment;   

-    on the application of insuring measures; on collection of pension for maintaining children; 

-    on the establishment of judicial protection.   

The decision was taken, after some members of the Commission had presented reports showing attempts of adoption of dubious and dangerous decisions for the state’s security.  

The judging of suspended civil cases will be resumed ex office after the ceasing of the emergency state.      

The criminal prosecution activity and the one of the investigating judges will be carried out only as to the causes:  

-    in which they instructed or proposed the taking of preventive measures or the ones of protection of victims and witnesses;  

-    the ones on the provisional application of safety medical measures, the ones in which minors are involved as the aggrieved party;   

-    the postponing of which would endanger the getting of evidence or the catching of the suspect, accused person or defendant, generate imminent risks of committing a new offence and/or the continuing of criminal activities, catching in act, efficiency of the special investigation measures, as well as the ones on the anticipated hearing.   

Based on the CSE decision, the procedures of forced execution will be suspended, except for the ones dealing with the following of the sums which are to be made revenue of the state; maintenance pension; sums for the repair of the damages caused through the bodily injury, through another harming of the health or through death; on the collection of allowances for temporary incapacity for work and other social insurance services provided for by the law, etc.    

The providers and distributors of audiovisual media services of television and radio will suspend the spread and rebroadcasting of all programmes which initially were produced in states which did not ratify the European Convention on Transfrontier Television, except for the feature films and short-reel films, as well as entertaining programmes. Exception represents products made in the EU, USA and Canada.   The Commission for Emergency Situation members approved a decision to this effect today.  

The Audiovisual Council will be able to suspend, on the period of the emergency state, the broadcasting licence of the providers and the authorization of rebroadcasting of distributors.   

At the same time, to efficiently manage the crisis triggered by the flow of refugees, the Commissions for Emergency Situations of the Local Public Administration Authorities will work in permanent regime in all districts of Moldova. On the period of the emergency state, the government’s representatives in the territory or their deputies will obligatorily be members and deputy heads of CSE and of the Local Public Administration Authorities, with the right to convene its meeting.     

The local commissions will analyze the information about the rooms which can be used for the temporary placement of refugees and will inform, in 12 hours, CSE about the rooms identified, their state and the list of needs for their arrangement and work.
