Moldova to have new law on copyright, related rights

Chisinau, June 22 / MOLDPRES /- Cabinet of Ministers approved a draft law aimed at harmonizing copyright and related legislation with the regulations of the European acquis communautaire. The document is intended to provide a high level of protection to authors and copyright holders, the government's communication and protocol department has reported.

Thus, the draft provides for the standardization of legal norms in the field of intellectual property with reference to ensuring the observance of rights; regulating the right of performers to obtain an additional annual payment; completing the list of exclusive property rights of interpreters and other subjects of related rights; establishing single rules for collective management of copyright and related rights; limiting the management fee to 30%; the obligation to draw up and publish an annual transparency report by collective management organizations.

The new law will benefit all stakeholders in copyright and related rights. In particular, the authors and holders of copyright and related rights will benefit from this law: it will increase the remuneration they deserve, taking into account the freedom to negotiate and set tariffs in methodologies, the clear and fair mechanism regarding compensatory remuneration, the recognition of new entitlements (eg. additional annual remuneration), the reduction of the management fee for collective management organizations and the new levers on access to any information related to the management of entitlements.

It aims to ensure high standards of governance, financial management, transparency and reporting.
