Moldovan parliament amends labour legislation

Chisinau, 28 July /MOLDPRES/ - The parliament today adopted amendments to the labour legislation, the goal of which is to enhance the productivity and competitiveness on the labour market.     

The document envisages the extension, from three to six months, of the test period for all categories of wage earners, except for the unqualified workers, for the complex verification of the professional aptitudes.  

The parliament also simplified the procedure of change of the working schedule, labour contract and of transfer to another unit. Another stipulation of the draft regards the shortening, from one month to 14 days, of the minimum period of bringing to the knowledge of the employees about the change of the working schedule in shifts.  

The draft revises also the procedure of reestablished in job office. Thus, the employer will be able to decide on the employee’s reestablishment in office or payment of a compensation of dismissal.   

To ensure predictability as to the return from maternity leave and the partially paid one for child care, compulsoriness to notice the employers will be introduced at least 14 days before the date scheduled for return. If the position is occupied - at least two months before return.  

Also, the new amendments refer to the regulation of the way of scheduling the annual leaves and employees’ familiarization with their schedule. The draft also sees the informing of employees about the attraction to additional work and the increase, from 120 to 240, of the number of additional hours per year, with the acceptance of the employee.  

As for the civil servants, the draft revises the procedure of their evaluation. Thus, a half-year assessment of civil servants is proposed. Also, the draft stipulates that the civil servants will be able to hold leadership offices only till the age of 65 years.    

The document regards also a new type of disciplinary infringement, which concerns the repeated unsatisfactory fulfillment of tasks.   

The document, passed in the final reading, was subjected to more rounds of public consultations. Representatives of the Labour and Social Protection Ministry, National Trade Unions Confederation, National Employers’ Confederation and other associations participated in the consultations. The draft also got a positive opinion on behalf of the development partners.
