Amendments to Law on bailiffs entered into force

Chisinau, 13 Jan. /MOLDPRES/- The promulgation decree and the Law amending Law No113/2010 on bailiffs were published today in the Official Journal and entered into force.

The document sets the method and term for contesting individual administrative documents issued by the Disciplinary Board and the Minister of Justice, aimed to suspend or terminate the activity of the bailiff. Also, some inconsistencies related to the effects of the application of the disciplinary sanction regarding the withdrawal of the bailiff's license were eliminated.

The new law sees that the termination of the activity of the bailiff, in the case of the application of the disciplinary sanction in the form of license withdrawal, will occur on the date of publication of the order of the Minister of Justice regarding the termination of the activity of the bailiff, which will be issued within five days from the date of publication of the College's decision disciplinary. Thus, any kind of extensive interpretations, which were generated when calculating the statute of limitations for disciplinary liability are eliminated, as the previous variant did not provide clarity in this regard.
