
Chisinau, 25 October /MOLDPRES/ - The members of the parliamentary commission for agriculture and food industry today considered the draft of the new Land Code.
The new document has the goal to regulate the legal regime of the land fund and of the land relations established between people. The draft proposes a new classification of lands and of the ways of their use.
According to the author of the legislative initiative, Agriculture and Food Industry Ministry (MAIA), the elaboration of the draft Land Code was aimed at creating a normative framework of regulating the land relations adapted to the new realities.
The document contains provisions on the new classification of lands, the ways of their use, the title on lands, classifications of lands with agricultural purpose, of the forest fund, waters’ fund, lands meant for constructions and arrangement, of special lands, as well as of those meant for protecting the nature and of the historical and cultural value. One of the chapters of the document regards the norms as to the sale of lands, as well as the obligations of the landowners.
The draft regulates also the way of change of the lands’ purpose, of compensation of the losses caused by the change of their purpose. Also, the draft envisages norms dealing with the withdrawal of lands from the agricultural circuit, actions of protection and amelioration of soil, monitoring of soil’s quality, etc.
The new law contains also norms on the state control in the field of land relations, settlement of the land litigations and the responsibility for the non-observance of the land legislation. Thus, the state control over the use and protection and lands will be exercised by the government and the local public administration authorities.
At the same time, the new Land Code contains a string of provisions from the Law on the state regulation of the regime of the land property, state land cadastre and land monitoring, from the Law on the normative price and the way of sale and purchase of land, as well as from other normative acts in the field, which will abrogated on the date of the entrance into force of the new Land Code.
