Mechanism of recovery of expenses for providing state guaranteed legal assistance amended in Moldova

Chisinau, 14 February /MOLDPRES/ - The recovery of expenses for the providing of state guaranteed legal assistance will be made through a new mechanism. The document and the presidential decree on the law’s promulgation were published in the Official Journal (Monitorul Oficial) today.  
Under the document, the monetary benefit owed by the beneficiary of the state guaranteed legal assistance is falling due following the expiration of a term of 30 days after the date indicated in the  notification on the reception of the decision on recovery, confirmation of the decision’s submission or decision’s communication through advertising. If the debt was not paid voluntarily, it will be enforced in line with the procedure of payment of the financial debts, based on public law principles, approved by the government.    
At the same time, to ensure guarantees as to the communication of the decision on recovery, if its notification by mail with letter of recommendation, note on receipt or by other means which would ensure the receipt’s confirmation (email, telegram, etc.) was not possible, additional procedures of decision’s communication are proposed, similar to those of acts’ notification to the State Fiscal Service.  
The present law enters into force on the date of its publication in the Official Journal. The provisions apply to the decisions on the recovery of expenses for the providing of state guaranteed legal assistance, on which the foreclosure procedure was not initiated.
