Moldovan parliament to first ever assess legislative acts approved

Chisinau, 7 February /MOLDPRES/ – For the first time, Parliament will carry out, during 2018, the legal and impact analysis of several laws. The decision was taken by the Standing Bureau of the Parliament (BPP), which approved the ex – post evaluation methodology regarding implementation of legislative acts.

According to the parliament’s communication and public relations department, the ex – post evaluation of implementation of legislative acts is one of the instruments for achieving parliamentary control, being a priority of the parliament. So far, parliament has not used the ex – post evaluation tool.

The ex – post evaluation allows the parliament to analyze data on how legislative act was implemented, if all necessary documents were approved, impact on society and specific domains or groups, which are economic, financial, social, administrative effects etc., which were possible reasons that prevented implementation of legislative act.

"We are waiting for proposals from standing committees so that, starting this year, we can evaluate legislative acts approved by parliament. The legislature has to monitor consistently how the laws are implemented and if they are effective into enforcement process," said Speaker of Parliament, Andrian Candu.

The process provides two ways of evaluation: legal, to verify whether all necessary regulatory acts have been approved or if there are impediments to law enforcement and impact, in order to analyze the effectiveness of the legislative act, as to improve its implementation. The ex – post legal analysis can be done 1 year after entry into force of legislative act and ex – post impact analysis – after 3 years. The ex – post impact assessment process can take up to 6 months, and the legal one –  up to two months. In the evaluation process, the representatives of target groups and stakeholders are to be consulted: central and local public administration authorities, experts, academics, professional institutions and non – governmental organizations (NGOs).

Following ex – post evaluation, the parliament will take decisions on continuation, modification, repeal or replacement of legislative act with a new one.

The BPP, in agreement with heads of parliamentary factions and standing committees, is to approve the ex – post evaluation plan on implementation of legislative acts. The ex – post evaluation plan will be published on parliament's website.

Previously, the Speaker of Parliament announced that one of legislative acts that might be subject to ex – post evaluation is the code of education.

The ex – post evaluation methodology on implementation of legislative acts was elaborated by support of UNDP project: Strengthening the parliamentary governance in Moldova.
