Civil servants holding leadership positions at Moldovan state institutions have no right to participate in strike

Chisinau, 25 April /MOLDPRES/ - The people holding leadership offices, including high-ranking ones, in the central public administration (ministries and other central administrative authorities) have no right to participate in strike. The government today approved a classified list of units, sectors and services whose employees have no right to participate in strike.   

Under the document, the participation in strike of persons holding leadership positions from the secretariat of the parliament, State Chancellery, apparatus of the head of state, guard staff of medical and pharmaceutical institutions, no matter the type of ownership and their legal form of organization, as well as from the National Agency for Public Health is limited. The same bans are applied also in the case of wage earners involved in operative services of maintenance and management of infrastructure and services of electronic communications from the communications units, all employees of the energy supply units, agencies providing water supply services.

At the same time, the prosecutors, judges, military, civil servants with special status from the National Anticorruption Centre, Customs Service, etc. are deprived of the right to participate in strike.         

Under the article 369 of the Labour Code, the classified list of units, sectors and services whose employees cannot participate in the strike is approved by the government. This provision, as well as a cabinet decision from 2014 was appealed at the Constitutional Court by the Ombudsman. Following the consideration of the notification, the Court declared the stipulations of the Article 369 of the Labour Code constitutional.
