Mechanisms on judges' disciplinary liability to be optimized in Moldova

Chisinau, 29 December /MOLDPRES/ - The draft laws which regard the optimization of the mechanisms on judges’ disciplinary liability and of the work of the Judicial Inspection was voted in the first reading today.
The document proposes the removal of the conditions concerning the existence of the damage inspection report which remained final as reason for the dismissal from office of the judge, if situations of incompatibility appear.
Another provision of the draft law regards the way the activity of the judges inspectors is assessed. Thus, the activity of the judges inspectors, appointed by the Superior Council of Magistracy (CSM) for a six-year term, will be subjected to evaluation by CSM once in two years. The procedure and criteria of evaluation will be established through a regulation approved by CSM. The amendments suggested refer to the right of the Judicial Inspection to take note, in order to verify the deeds which can be disciplinary infringements. At the same time, to provide technical, organizational and administrative assistance in the work of the Judicial Inspection, the MPs propose the establishment of a distinct subdivision within CSM, due to provide needed support for optimizing the activity of the judges inspectors.
The draft law also provides for the increase, from two to three years, of the limitation period as regards the holding judges liable disciplinarily, the standardization of the process of judges’ dismissal from office, as well as the exclusion of the sanction concerning the salary’s cutting from the list of disciplinary sanctions applicable to judges.
