DOC Liquidation of Shor Party in last phase: Justice Ministry creates commission in charge of its erasing

Chisinau, 29 August /MOLDPRES/ - The Justice Ministry has created the Commission for the liquidation of the Shor Party, declared unconstitutional by the Constitutional Court (CC). The Commission will be made up of seven members. Justice Minister Veronica Mihailov-Moraru has signed an order to this effect, published in the today’s issue of the Official Journal (Monitorul Oficial).    

Under the order by the justice minister, the Commission is made up of the following members: Ion Popa – deputy president of the Council of the Union of Authorized Administrators of Moldova; Lilia Voiticovschi – head of the financial and economic department of the Central Electoral Commission (CEC); Ruslan Nastas – deputy head of CEC’s legal department; Pavel Dima – deputy head of the legal expertise general department of the State Fiscal Service (SFS), Tatiana Ianciu – chief officer of the legal directorate of the Interior Ministry, Angela Popil – lawyer and Olga Burea – lawyer.     

The deputy president of the Council of the Union of Authorized Administrators of Moldova, Ion Popa, and lawyer Olga Burea were nominated as liquidators of the Shor Party within the liquidation commission.   

The members of the commission for liquidation of the Shor Party will be monthly remunerated with 16,000 lei each and other people will be able to be invited for hearing at the meetings summoned.

The Constitutional Court declared the Shor Party unconstitutional on 19 June 2023. The process of consideration of the request on the outlawing of the Shor Party was initiated based on a notification submitted by the government to CC, through which the cabinet asked to verify the party’s constitutionality. The examination sessions started on 10 May this year. Participants in the sessions set forth evidence, according to which the Shor Party would have bribed voters and participants in the protests, as well as would have organized their carriage. The Shor Party’s representatives turned down the statements and described them as ‘’political.’’  

At the decision approved by CC, judge Serghei Turcan formulated a dissident opinion, while magistrate Vladimir Turcan formulated a separate opinion. The representatives of the Shor Party described the CC ruling as ‘’abusive and criminal.’’ According to them, this will be ‘’the first ruling of the Court which will be cancelled by the European Court of Human Rights.’’ For their part, the government’s lawyers describe the CC’s ruling as ‘’historical one for the democracy of Moldova, as it is grounded and based on the evidence presented by the cabinet.’’     

In a notification by the Commission for Democracy through Law of the Council of Europe (Venice Commission), requested by the Constitutional Court, European experts said that ‘’the banning of a political party is an extreme measure, which can be enforced only if all restrictive measures failed and the court should attentively analyze all arguments of the government.’’ The Venice Commission’s experts agreed that ‘’the war in Ukraine enhanced the security risks against Moldova.’’
