Notary to be able to loosen marriage

Chisinau, 15 November /MOLDPRES/- Divorce by agreement between spouses may be made to the notary, according to a draft law that was adopted today in the final reading by parliament.

Under the document, the divorce application may be submitted to any notary on the basis of the joint consent of the spouses and in their presence. The application shall be made in writing, following the model approved by the Ministry of Justice.

At the time of filing the application, the notary will give the spouses, according to the Family Code, a period of 30 days for any withdrawal of the application. The deadline for withdrawing the application may be extended by up to 30 days. Upon the expiration of the term, the notary shall issue a conclusion on divorce by mutual consent and within three days will sent it to the territorial civil status body for registration of the document.

At the same time, the draft provides for situations in which the notary may reject the divorce application. Thus, the notary issues a decision rejecting the application if one of the spouses cannot express his / her free consent, the application is not signed by both spouses, they refuse to give the declarations provided by the law or do not present all necessary documents, the spouses reconcile and withdraw the application. In the case of rejection of the application, the notary issues a conclusion in this respect.
