Moldova to have new Town Planning Code

Chisinau, 16 December /MOLDPRES/ – The parliament voted the Town Planning and Constructions Code in the second reading on 15 December evening.  

The document establishes the unitary legal framework which will regulate the relations in the fields concerning the territorial arrangement and town planning, authorization and carrying out of construction works, ensuring the quality of constructions, of the materials and products for constructions, exploitation of constructions, as well as the consistent enforcement of the legal provisions in the field of use and post-use of constructions in Moldova.    

The new code is meant to systematize the provisions regarding the stages covered for the construction of a building, starting with the concept, designing, authorization, carrying out, exploitation, following the behavior during time, as well as the state’s control in the post-use of constructions. As for the state’s control, the new code contains provisions which regard the goal of the control, the deeds which represent infringement in the field of quality in constructions, the competent authority in the state control, the way the state control is carried out, etc.    

The draft of the Code also contains provisions on the way the town planning certificate and the authorization for construction/dismantling are issued. Thus, the authorization for the carrying out of constructions in settlements will be made only based on the town planning documents, elaborated, examined and approved according to the law. At the same time, exceptions are also seen: for the rural settlement with a population which does not exceed 3,000 residents, the issuance of the town planning certificate for designing will be made according to a regulation approved by the government. About 679 settlements, an estimated number of 1.5 million residents, will benefit from this simplified procedure.  

The state register of the companies in the field of town planning and constructions, kept by the National Inspectorate for Technical Supervision, will be created in Moldova for the first ever.   

One chapter of the document is dedicated to the intervention of the state and local public administration as to the measures of reducing the seismic risk at the existing constructions, as well as regarding the rehabilitation and modernization of buildings.
