Moldovan cabinet returns to issue of removing compulsoriness of stamp in entrepreneur's work

Chisinau, 20 June /MOLDPRES/ – The Cabinet of Ministers has adopted today the amendment of some Government decisions on abolition of stamp duty in entrepreneurial activity, including road transport and export of goods through points of the Moldovan-Ukrainian border where joint control is established.

The Project Info Note states that point 89 of Regulation on issuance and use of road transport authorisations stipulates that holder name and corresponding ECMT authorisation number shall be entered on road book, as a result of which stamp of holder of CEMT authorisation becomes unnecessary.

The decision also provides for removal of stamps in case of exports of goods through Moldovan-Ukrainian state border crossing points in which joint control is established, in particular Pevomaisk-Cuciurgan. The legislation in force provides that "the exporter/legal representative shall print certificate of origin forms stored in "Origin of Goods Certificate" of customs info system ASYCUDA World, indicate place and date of completion of certificate, signature and/or stamp of exporter, free trade". Respectively, words "and/or stamp" are to be excluded.

In addition, words "stamp applied" by food business operator stating that products have been obtained in approved veterinary establishments shall be replaced by "distinguishing mark applied".

On 07 July 2016, The Parliament adopted a draft amending and completing some legislative acts, which excluded from the text of some laws the obligation to use stamp in the activity of economic agent, stamp becoming an optional element. Also, it was considered rational that stamp should remain obligatory for public authorities, considering that they represent state power, notes the Ministry of Justice (MJ).

The project authors, approved by government today, underline project drafting was based on same reasoning as Law of July 2016, namely that in context of development of modem technologies, stamp applied on a document no longer guarantees act veracity. In this sense, wet stamp becomes a rudimentary exercise that needs to be replaced by other identification methods.

The estimates suggest that canceling stamp duty for entrepreneurs would reduce cost of launching businesses by 30 per cent, having positive impact on companies, especially for young entrepreneurs in innovative areas.
