Chisinau, 3 February /MOLDPRES/ - The members of the Superior Council of Prosecutors (CSP) today came up with specifications as to the validity of their mandates, after more information appeared, alleging that the CSP members’ mandates are expired.
A press release signed by five CSP members reads that ‘’the mandate of the current composition of CSP was regulated under the Law No 26 from 10 March 2022 on the measures related to the selection of the candidates for the office of member in the self-management bodies of the judges and prosecutors, which clearly established in the Article 15, paragraph 11: by derogation, the mandates of the CSP members, except for the mandates of the de jure members, are prolonged, through extension, till the office is held by the competent successors.’’
“Taking into account many discussions in the public space about the allegedly ‘’expired’’ mandate of the CSP members, we deem it necessary to intervene with specifications, in order to exclude the misleading of the society. The initiative of adopting this law belonged to the Justice Ministry and the act was approved with the votes of the parliamentary majority and represents an expression of will of the legislative body. We reiterate that the validity of the CSP members’ mandates was extended under law, which excludes any speculations on this subject,’’ the press release reads.
Those five CSP members say that the procedures of organization of the general assembly of prosecutors have been earlier initiated. Yet, ‘’objectives circumstances appeared and its holding was not possible and subsequently, after the law entered into force and the procedures of evaluation of candidates to the self-management bodies started, it is obvious that the election of the new CSP members will be possible only after the conclusion of these verifications.’’
