Moldova's Commission for Emergency situations adopts decision on avoiding of blockage in justice system

Chisinau, 31 March /MOLDPRES/ - Prime Minister Dorin Recean has summoned a meeting of the Commission for Emergency Situations (CSE), in order to consider, at a proposal by the Justice Ministry, the measures needed to avoid the blockage of the justice system, the government’s communication and protocol department has reported.

The CSE members found out the emergency situation existing at the Supreme Court of Justice (CSJ) and ruled to adopt an extraordinary measure on the suspension of the applications on resignation for a 30-day period, in order to ensure the CSJ’s functionality.  

„This is an instrument of quick intervention, an extraordinary, but a necessary measure. We must adjust and ensure the legal framework of work of the justice, in order to diminish the risks which can appear and ensure the people’s access to justice. This is an extra opportunity for the honest judges to make a step forward and act for the benefit of the citizens,’’ PM Dorin Recean said.   

According to Justice Minister Veronica Mihailov-Moraru, given that more judges resigned and there is a risk for the Supreme Court of Justice to interrupt its work and of a possible ceasing of files’ consideration, the enforcement of this temporary measure is needed.    

„If most vacant positions existing at the Supreme Court of Justice are filled earlier, this decision can be revised at any time. The decision is taken, in order to ensure the public interest, so as to continue the process of consideration of the priority files, including of the contestations submitted against the pre-vetting commission. Moreover, taking into account the essential role played by the system of courts in the process of defence of human rights and the access to justice, it is essential that we preserve its uninterrupted functionality on the period of the emergency state,’’ Veronica Mihailov-Moraru said.       

During discussions in the parliament’s plenum on 30 March, Prime Minister Dorin Recean, in its reasoning of the extension of the emergency state, referred also to the exacerbated risks and the serious, unprecedented situation existing in the justice system.
