Vetting Commission starts process of evaluation concerning five judges of Moldova's Supreme Court of Justice

Chisinau, 27 July /MOLDPRES/ - The independent commission for external evaluation of the candidates for the office of judge of the Supreme Court of Justice (Vetting Commission) has started the process of evaluation as to those five magistrates in office of the Supreme Court of Justice (CSJ).   

According to the Commission, it is about Tamara Chișca-Doneva, Ion Guzun, Aliona Miron, Mariana Pitic and Anatolie Țurcan.

Thus, the Vetting Commission notified each of those five judges about the initiation of the procedure of evaluation and asked the magistrates to submit the declaration of wealth and personal interests, with updated data for the last five years, which is to include also the spending from the concerned period, the Questionnaire of Ethics, as well as the declaration on the list of close people who work or have worked in the judicial system, the one of prosecutor’s office and in the public service in the last five years. These documents are to the submitted to the Commission in the terms established by the law, not later than 20 days after the date of request.     

Following the submission, the Commission will consider the filled in declarations and the questionnaire of ethics and will carry out additional investigations and eventually hearings, in order to compile a motivated report due to show the conclusion of the Commission, if a judge meets the criteria of financial and ethic integrity or not. The report will contain the proposal on the passage or non-passage of the evaluation by the judge and will be submitted to the Superior Council of Magistracy.    

„The lack of a reasonable justification for the refusal to submit or the non-submission on term of the declarations or the questionnaire of ethics represents ground for the ascertaining by the Commission of the non-passage of the evaluation. The judges who submit an application on resignation in a period of 20 days after the notification on the starting of the evaluation will not be subjected to the evaluation process,’’ reads a press release by the Commission.  

The Vetting Commission was set up by the parliament. Six of its members were nominated by the parliament’s plenum with the votes of three fifths of the number of MPs elected on 15 June 2023. Three members citizens of Moldova were put forward by the parliamentary factions, taking into account the proportional representation of the parliamentary majority and opposition and another three members were recommended by the international development partners, which provide technical assistance to Moldova.
