New rules for members of political parties declared unconstitutional

Chisinau, July 31. /MOLDPRES/- The members of political parties declared unconstitutional will not be able to be elected for a period of three to five years from the pronouncement of the decision of the Constitutional Court. A draft to amend the legislation was approved today in the first reading by the Parliament.

The legislative initiative was set up by a group of deputies from the Action and Solidarity Party Faction, in the context of adjusting the internal regulatory framework regarding the liquidation of political parties, after the Constitutional Court issued a Decision declaring the Shor Party unconstitutional and dissolved it.

The draft law also contains the provision that the attributes of parties declared unconstitutional will not be able to be used by other political parties, electoral blocs or other electoral competitors.

The head of the legal commission on rules and immunities, Olesea Stamate, said she had registered an amendment stipulating that the electoral body will be able to ascertain the facts of voter corruption and will be able to order the cancellation of the registration of the candidate or the electoral competitor.

Olesea Stamate proposed adding two crimes to the Criminal Code - passive political corruption (claiming, accepting or receiving by a public person in the exercise of the mandate obtained as a result of the election of goods, services, privileges or advantages in any form in order to leave a political formation or to join another formation) and active corruption (promising or offering a public person in the exercise of the mandate obtained as a result of elections of goods, services, privileges or advantages to leave a political formation or to join another political formation). Accordingly, passive political corruption will be punishable by up to seven years in prison, with a fine of up to 300,000 lei, and active political corruption will be punishable by up to six years in prison, with a fine of up to 200,000 lei . Aggravating forms are provided for both crimes.
