Decision No 60 of National Extraordinary Public Health Commission from 23 August 2021

Based on the analysis of the epidemiological situation through the infection with the SARS-CoV-2 virus, the National Extraordinary Public Health Commission (CNESP) finds out that the evolution of the epidemic process is unfriendly, with tendencies of worsening. In the last weeks, an increase in the number of Covid-19 cases has been registered in Moldova. For the last 14 days, the incidence of COVID-19 stood at 109 cases per 100,000 people. In the last period, the fatality rate grew up to 2.13 deaths out of 100 infections and the infectious rate reached 1.25, which represents a negative tendency in terms of forecasting.   
Proceeding from the abovementioned, under the Article 58 from law No 10/2009 on the state supervision of the public health (Official Journal of Moldova, 2009, No 67, Article 183), with the subsequent amendments, in order to safely organize the education process for all public and private education institutions as of 1 September of the 2021-2022 school year, National Extraordinary Public Health Commission  
DECIDES:
1. To approve the instruction on the measures of organizing the work of the elementary education institutions, gymnasiums and lyceums, vocational schools and higher education institutions (public and private) for the 2021-2022 school year, in conditions of epidemiological safety, in order to prevent the infections with SARS-CoV-2 virus, according to the annex.     
2. Starting from 1 September 2021, the work of the elementary education institutions, gymnasiums and lyceums, vocational schools and higher education institutions will be carried out with the physical presence in all units, in conditions of the observance of the provisions of the instruction approved through the present decision. The subsequent decisions will be adopted depending on the evolution of the epidemiological situation and the vaccination rate for each institution separately.  
3. Taking into account the unfriendly evolution of the epidemic process with tendency of worsening, on 1 September 2021, no festivities or other public events dedicated to the beginning of the 2021-2022 will be held at the headquarters of the education institutions, including in yards.  
4. Given that the staffs in the education system are made up, to a great extent, of children, a group which is not protected through immunization against Covid-19, to prevent the transmission of the infection with the SARS-CoV-2 virus in the school apace, CNESP recommends that at least 95 per cent of the adult people from each education institution be vaccinated till 1 October 2021.   
5. To organize the protection of the health of children and young people involved in the education process, the state will encourage and promote in continuation the vaccination of the teaching staff, non-didactic and auxiliary staff against COVID-19.
6. Till reaching the recommended level of vaccination of 95 per cent, the non-vaccinated teaching staff, non-didactic and auxiliary staff will present, at their own expense, once in 14 days, the result of a diagnosis test for COVID-19 (a quick test AgSarsC-oV-2 or a PCR test for COVID-19).   
7. The people who present the following documents are not subjected to testing indicated in the point 6:  
7.1. certificate of vaccination against COVID-19 with the full scheme of vaccination (with any type of authorized vaccine);
7.2. medical conclusion which confirms that the person was infected with COVID-19 on the period between the 15th day and 180th day (six months) or a confirmatory act on the presence of anti-COVID-19 antibodies. The confirmatory act on the presence of antibodies anti-COVID-19 is valid for a period of 90 days after the date when the investigation was made.
8. As for the festive events dedicated to the National Holiday Independence Day of Moldova:
8.1. The military parade will be held provided that all participants in the subdivisions involved are vaccinated against COVID-19. The leaders of the authorities participating will ensure the control of the observance of the present provision;  
8.2. CNESP recommends the limiting of the number of guests and the measures of protection against the spread of the SARS-CoV-2 virus will be compulsorily observed on the platform of the guests and in all spaces involved:
8.2.1. physical distance of at least one metre;
8.2.2. wearing of protection masks;
8.2.3. presenting: (i) the certificate of vaccination against Covid-19, with the full scheme of vaccination (with any type of authorized vaccine) or (ii) the negative result of the RT-PCR test not older than 72 hours or the certified negative result of a quick antigen test for the infection with the SARS-CoV-2  not older than 48 hours or (iii) a medical conclusion which confirms that the person was infected with COVID-19 on the period between the 15th day and 180th day (six months) or a confirmatory act on the presence of anti-COVID-19 antibodies. The confirmatory act on the presence of antibodies anti-COVID-19 is valid for a period of 90 days after the date when the investigation was made.   
8.3. Taking into account the unfriendly evolution of the epidemic process with tendency of worsening, CNESP recommends the organization of all cultural and artistic actions dedicated to the National Holiday Independence Day of Moldova with shortened schedule (not later than 17:00) in all settlements and with the compulsory observance of all measures of protection against the spread of the SARS-CoV-2 virus, including the observance of the physical distance of at least 1 metre and wearing or protection masks by the audience.    
9. The authorities in charge of the order and public security sectors will boost the monitoring and control of the observance by private people and legal entities of the measures of prevention and combating of the COVID-19 infection.
10. The decisions of the National Extraordinary Public Health Commission are executory for the central and local public administration authorities, for natural and legal persons, regardless of the field of activity and the legal form of organization.
11. Representatives of the media are requested to inform the public about the provisions of this decision and the need to strictly observe the restrictive measures and the measures for the prevention and control of COVID-19 infection.
12. Failure to comply with the public health measures set out in this Decision constitutes a danger to public health and will serve as a basis for the application of measures for the contravention and / or criminal liability of natural and legal persons.
13. The present decision enters into force at the moment of its issuance and is published on the government’s official page.
