Moldova's Constitutional Court declares unconstitutional amendments that allowed Herman von Hebel’s appointment to prosecutors’ evaluation commission

The Constitutional Court today declared unconstitutional the legislative amendments that had allowed Herman von Hebel to be appointed as a member of the prosecutors’ evaluation commission. The decision was issued by the High Court after examining a referral submitted by MPs Ion Chicu, Alexandru Berlinschii, Adrian Lebedinschi, Diana Caraman, and Alexandru Versinin.

The referral concerned legislative provisions that reduced the number of votes required to appoint foreign members to the evaluation commissions for judges and prosecutors from 61 to 51.

The amendments were introduced in last March into the two laws regulating the external evaluation process for judges and prosecutors.

Under the challenged provisions, if the draft parliament resolution on the appointment of foreign members failed to secure the required number of votes, the legal commission for appointments and immunities could reconsider the candidates during the same session and select those who received the most votes.

Herman von Hebel in last March was appointed as a member of the prosecutors’ evaluation commission, an institution involved in the external integrity assessment of prosecutors from Moldova.
