
Moldovan top court disapproved initiative to amend Constitution
Chisinau, March 15 / MOLDPRES /- Constitutional judges disapproved an initiative to amend point three of Article 46 of the Constitution of the Republic of Moldova.
It is related to the right to private property and its protection.
The President of the Constitutional Court, Domnica Manole, explained today, during a press briefing, that the wording proposed by the authors of the amendment to Article 46 of the Constitution "is unconstitutional, because it places people holding public office in the state in an imbalance before the legal authorities. ”.
According to the constitutional judge, "the amendment proposed by the group of deputies would have resulted in the abolition of the right to property of persons holding positions in the state."
Point three of Article 46 of the Constitution refers to the legal nature of the property held by citizens and reads as follows: “Property lawfully acquired may not be confiscated. The lawful nature of the acquisition is presumed. " The parliamentarians wanted to complete this paragraph with the phrase "except for civil servants".
Manole specified that the current text of Article 46 of the Constitution does not prevent the confiscation of unjustified assets.
