Passed in first reading: New rules on activities outside working hours by special-status officials of Ministry of Internal Affairs
Chișinău, November 5, 2026 – Parliament supported in the first reading a draft law providing for the updating of the incompatibility regime applicable to civil servants with special status of the Ministry of Internal Affairs.
The draft law expands the categories of activities they may perform outside working hours and establishes the conditions and mechanisms for their notification, assessment, authorization, and monitoring. Thus, they will be able to carry out scientific, teaching, and creative activities, participate in development projects in their field of expertise, and represent the state in companies.
At the same time, civil servants with special status will be prohibited from performing remunerated activities within other public authorities, holding positions of public dignity, or working in the offices of public officials. They will also be prohibited from carrying out remunerated activities, based on an individual employment contract or another civil contract, within commercial companies, cooperatives, state or municipal enterprises, and non-commercial organizations in the public or private sector, if these entities are under the control or authority of the institution where they are employed, or if their activity falls within the competence of that institution.
The draft law maintains the prohibition against holding the position of administrator of a private-law legal entity and engaging in entrepreneurial activities. The document also establishes officials’ obligation to eliminate any incompatibility situation within one month of its occurrence.
The proposed amendments aim to strengthen the legal framework applicable to public officials with special status and align it with international standards. The initiative is in line with the recommendations of the Group of States against Corruption (GRECO), set out in the April 2024 report following the fifth evaluation round on preventing corruption and promoting integrity at the central level and in law enforcement institutions.
The draft law amending the Law on civil servant with special status of the Ministry of Internal Affairs is to be debated in the second reading.
