New rules on activities performed outside working hours by special-status civil servants within Ministry of Internal Affairs
Chișinău, November 4, 2026 – The Committee on National Security, Defense and Public Order approved the report on a draft law providing for the updating of the incompatibility regime applicable to public officials with special status within the Ministry of Internal Affairs.
The draft law expands the categories of activities that these officials may perform outside working hours and establishes the conditions and mechanisms for their notification, assessment, authorization, and monitoring. Thus, officials will be able to carry out scientific, teaching, and creative activities, participate in development projects in their field of competence, and represent the state in commercial companies.
At the same time, public officials with special status will be prohibited from carrying out paid activities within other public authorities, holding public office positions, or working in the offices of public dignitaries. They will also be prohibited from performing paid activities, under an individual employment contract or another civil contract, within commercial companies, cooperatives, state or municipal enterprises, and non-commercial organizations in the public or private sector, if these entities are under the control of or subordinated to the authority where they are employed, or if their activity falls within that authority’s area of competence.
The draft law maintains the prohibition on holding the position of administrator of a private-law legal entity and engaging in entrepreneurial activities. It also establishes the obligation for officials to eliminate any incompatibility situation within one month of its occurrence.
The proposed amendments aim to strengthen the legal framework applicable to public officials with special status and align it with international standards. The initiative is in line with the recommendations of the Group of States against Corruption (GRECO), set out in the report of April 2024, following the fifth evaluation round on preventing corruption and promoting integrity at the central level and in law enforcement institutions.
The draft law amending the Law on public officials with special status of the Ministry of Internal Affairs is to be submitted to Parliament for consideration in the first reading.
