New candidate for Disciplinary College of Moldova's Superior Council of Magistracy to undergo external evaluation
The Judges’ Evaluation Commission has initiated the verification procedure regarding lawyer Ruslan Berzoi, who is running for the position of member of the Disciplinary College of the Superior Council of Magistracy (CSM).
With the initiation of the procedure, the Commission requested that the candidate submits the primary documents necessary for the evaluation, updated as of the current date. Under the law, within seven days after receiving the request, the candidate must submit the Declaration of Assets and Personal Interests for the last five years, the Ethics Questionnaire and the Declaration regarding close persons who are or have been employed, in the last five years, in the judiciary, the prosecution service or in the public service.
The evaluation will be carried out by the Commission from the perspective of financial and ethical integrity, in accordance with the criteria established by the Law on certain measures related to the selection of candidates for membership in the self‑administration bodies of judges and prosecutors.
Ruslan Berzoi has been earlier evaluated by the Commission as a candidate for the position of judge of the Supreme Court of Justice and passed the evaluation conducted under the Law on the external evaluation of judges and prosecutors.
The Law on certain measures related to the selection of candidates for membership in the self‑administration bodies of judges and prosecutors provides for a more extensive verification of financial and ethical integrity. In terms of financial integrity, the evaluation may cover assets and interests for a period of up to 15 years and is not conditioned by a minimum value threshold of unjustified assets. At the same time, the ethical integrity criterion has a broader scope of application and is not limited to a specific period of time.
