Confiscated assets and financial means obtained from criminal activities will be available for use in social and public interest purposes. A law to this effect was published in the Official Journal of the Republic of Moldova today.
The draft was worked out by the Ministry of Justice, based on proposals from public institutions and civil society organizations. According to the authors, the document aims to increase the efficiency of the asset recovery process and financial crime investigations, as well as to ensure proper management of seized assets for the public benefit.
Under the new provisions, the Criminal Asset Recovery Agency will keep records of confiscated assets, except for monetary amounts, which will be managed by the State Tax Service. The Agency will publish a list of available assets, and public institutions and non-governmental organizations will be able to request their use.
The draft also provides for the establishment of the Commission for the Management of Confiscated Assets, consisting of nine members. Eight of them will represent various ministries, and one member will represent civil society, being designated by the Ministry of Justice. The Commission will evaluate the applications and decide on the use of assets or confiscated amounts for social or public interest purposes.
After the transfer of assets to beneficiaries, the Criminal Asset Recovery Agency will monitor how they are used. At the same time, the draft stipulates that 70% of confiscated amounts will be transferred to the state budget, 20% will be directed to social use and 10% will be allocated to public authorities for public interest projects.
The new regulations will enter into force two months after publication in the Official Journal.
