Regulatory framework for extractive waste management harmonized with EU standards in Moldova
The regulatory framework for extractive waste management has been harmonized with EU standards in this field. The MPs adopted, in the second reading, a draft law proposing amendments to the Subsoil Code.
The draft extends the deadline for submitting the documents required to get a subsoil use permit from 90 to 180 days. The amendment takes into account the complexity of certain administrative procedures and will allow operators to meet legal requirements while complying with environmental protection obligations.
Another provision concerns the establishment of a public inventory of closed extractive waste management facilities that pose risks to the environment or public health. The inventory will enable the authorities to identify and monitor these sites and establish the measures necessary to reduce the risks.
The draft law also introduces reporting requirements concerning the implementation of the provisions of the Subsoil Code in the field of extractive waste management. Accordingly, the Environment Ministry will submit periodic and annual reports to the European Commission on the implementation of these provisions.
At the same time, the draft law provides for the exchange of scientific and technical information with the member states of the European Union and the European Commission in the field of subsoil use and protection. The Environment Ministry and the competent authority in the field of subsoil use and protection will participate in this exchange of information to develop and apply methodologies for assessing the risks associated with activities regulated by the Subsoil Code, as well as methodologies for rehabilitating closed facilities, with a view to ensuring compliance with environmental protection requirements.
The draft law, developed by the Environment Ministry, aims to implement the actions set out in the National Programme for Moldova’s Accession to the European Union for 2025–2029 and ensures the full transposition of the applicable provisions of the EU Directive on waste from extractive industries.
