Voted in first reading: people with disabilities since childhood to be able to combine disability and survivor’s pensions in Moldova

People with severe disabilities since childhood will be able to receive both a disability pension and a survivor’s pension, regardless of when the death of the breadwinner occurred. The parliament voted, in the first reading, on a draft  providing for the possibility of combining the two types of pensions.

At present, this right is available to people with severe disabilities since childhood who lost their breadwinner after April 1, 2025.

The legislative initiative was drafted by MPs Marina Morozova and Efimia Bandalac, members of the parliamentary faction of the Action and Solidarity Party (PAS). The draft aims to strengthen the social protection of people with severe disabilities since childhood and ensure equal treatment for them.

The authors propose supplementing the Law on the Public Pension System with provisions allowing people with severe disabilities since childhood to receive both a disability pension and a survivor’s pension, without being required to choose one of the two benefits.

At the same time, the right to a survivor’s pension will be granted to people with severe disabilities since childhood, regardless of the date of the breadwinner’s death. This will eliminate the difference in treatment based solely on when the death occurred.

The draft will be examined by the parliament in the second reading. Following its adoption, the new provisions will enter into force on January 1, 2027. Approximately 35.37 million lei will be required for their implementation.

In 2025, the parliament adopted a legislative initiative extending eligibility for a social benefit for the loss of a breadwinner and for a survivor’s pension to people with severe disabilities since childhood. Thus, starting April 1, 2025, people with severe disabilities since childhood who receive state social benefits are entitled to a survivor’s pension, provided that one of their parents died after that date.
