Civil society candidate for Judges' College did not meet integrity criteria

The Evaluation Committee members rejected the candidacy of lawyer Denis Lesnic for the position of member of the College for the selection and evaluation of judges. Lesnic was proposed by civil society and failed the evaluation because he did not meet the integrity criteria, according to the Committee's statement.

"The candidate does not meet the integrity criteria provided by Law No. 26/2022, under which the evaluation procedure was carried out," the Evaluation Committee's conclusions state.

The decision regarding lawyer Denis Lesnic was made with the majority of votes from the nine Committee members. Separate opinions were expressed by members Scott Bales, Andrei Bivol, and Lavly Perling. 

The decision was sent to the candidate of the Superior Council of Magistracy (SCM), as the organizer of the competition for filling vacant positions in the two specialized judges' colleges.

Denis Lesnic is expected to notify the Committee, within 48 hours of receiving the document, if he opposes its publication. In the absence of notification, the decision will be published on the Evaluation Committee of Judges' website – www.vettingmd.eu.

All candidates for positions in the SCM specialized colleges, regardless of whether they come from the judiciary system or civil society, are subject to integrity evaluation. Candidates enrolled in the competition after September 1, 2023, are evaluated by the Evaluation Committee of Judges, in accordance with Law No. 252/2023 on the external evaluation of judges and prosecutors.

The decision was adopted with the majority of votes from the nine Committee members.
