Moldovan prosecutors’ evaluation commission says Constitutional Court’s ruling produces effects for future, does not affect acts issued previously based on challenged provisions

The Constitutional Court’s (CC) ruling on the procedure for appointing international members of the commissions for external evaluation of judges and prosecutors produces effects for the future and does not affect acts issued previously based on the challenged provisions. The prosecutors’ evaluation commission, which took note of the CC ruling, made statements to this effect today.

Through its ruling, the CC declared unconstitutional the provision in Law No. 252 concerning the procedure for appointing international members of the commissions for external evaluation of judges and prosecutors.

“The Commission takes note, in particular, of the clarifications made by the President of the CC, according to which the ruling produces effects for the future and does not affect acts issued previously based on the challenged provisions. The Commission will continue its work in exercising its mandate, in accordance with the applicable regulatory framework. The full text of the ruling will be examined after its publication,” the prosecutors’ evaluation commission emphasized.

Today, the Constitutional Court declared unconstitutional the legislative amendments that allowed Herman von Hebel to be appointed as a member of the prosecutors’ evaluation commission. The decision was handed down by the high court after examining a referral submitted by MPs Ion Chicu, Alexandru Berlinschii, Adrian Lebedinschi, Diana Caraman and Alexandru Versinin.
