More judicial procedures to be digitalized in Moldova: documents, summonses to be able to be sent electronically
More judicial procedures in Moldova will be digitalized, and procedural documents and summonses will be able to be transmitted electronically in all cases, after the parliament today approved, in second reading, a draft law supported by 62 MPs.
The initiative belongs to the Justice Ministry and includes proposals formulated by the Superior Council of Magistracy, the Justice Digitalization Agency and representatives of the courts. The draft is part of the actions set out in the Reform Agenda under the Growth Plan of Moldova for 2025–2027.
According to the new provisions, courts will be able to access, via the interoperability platform, information from databases and information systems managed by public authorities and institutions. This mechanism will facilitate the electronic communication of procedural acts, while the electronic addresses of the parties will be taken directly from public registers and updated periodically.
The Code of Civil Procedure will be supplemented, so that procedural documents can be communicated electronically, in particular through the Integrated Case Management Programme. The electronic transmission of summonses and notices will no longer be limited to urgent cases, but will be available in all case files.
The parties involved in the proceedings or their representatives will be required to inform the court of any change in their electronic contact address.
At the same time, certain statements of claim will be able to be filed online through the Integrated Case Management Programme, using a qualified electronic signature.
Digitalization will also be extended to contravention procedures. Procedural documents will be able to be communicated electronically and the ascertaining agents will be required to submit appeals and case files in electronic format via the Integrated Case Management Programme.
Amendments to the Administrative Code will allow the electronic filing of administrative litigation actions, the prior transmission of documents to the defendant and third parties, as well as the examination of certain cases by videoconference.
The new provisions will enter into force three months after publication in the Official Journal (Monitorul Oficial).
