People with modest incomes to receive free legal aid
Parliament of the Republic of Moldova approved today in the second reading a draft law establishing the partial granting mechanism of state legal aid for low-income people.
According to the document, set up by the Ministry of Justice, people with a monthly income of up to 7,150 lei will be able to receive state-guaranteed legal aid, being required to repay only 30% of the cost of services. The same provisions will apply in the case of requesting state-guaranteed mediation services.
The project also provides for the simplification of the procedure for requesting legal aid, by eliminating the requirement to attach the income statement to the submitted application.
Moreover, the law brings amendments to the Code of Criminal Procedure, clarifying that a defender who is unjustifiably absent or refuses to fulfill their obligations can be replaced in all cases where their presence is mandatory in the criminal process.
