Prime Minister orders changes to tax procedures after entrepreneur misses tax relief due to late filing

Prime Minister Vasile Tofan has ordered a review of procedures for applying tax incentives for entrepreneurs, after an entrepreneur from Ghidighici lost the right to a tax benefit because of a seven-day delay in filing the 2025 tax return.

According to the prime minister, the company, founded by a compatriot who returned from Sweden together with his brother, operates in the field of cold-pressed oil production and was benefiting from a tax incentive on reinvested profit.

"We continue to receive a lot of requests related to inspections, and I think it is good to keep our finger on the pulse of things, it is good to unblock certain matters. A few days ago, one case caught my attention. He returned from Sweden, started a business together with his brother in Ghidighici, in the field of cold-pressed oils. Their case now concerns the Tax Service, because they are a small company and benefit from the exemption on reinvested profit. They were one week late in filing the tax return for 2025. As a result, the Tax Service did not allow them to benefit from this reinvested profit incentive solely because they were seven days late," the prime minister noted.

Vasile Tofan asked the responsible authorities to analyze the case and identify solutions that would allow the application of a principle of proportionality. In his view, a minor administrative delay should not automatically lead to the full cancellation of a tax incentive.

"Indeed, the entrepreneur made a mistake in this case, but I believe the measure is disproportionate. The Tax Service acted in accordance with existing procedures; the problem is not with the Tax Service. And it is certainly not with the entrepreneur. The problem lies in the procedures. We need to change the procedure there and act proportionally in such cases. If someone is late, that does not mean the tax incentive must be cancelled; if there need to be some penalties, that is fine, but I do not think the tax incentive should be completely revoked," Vasile Tofan said.

In the first meeting of Tofan Government, the prime minister requested the development of a package of measures to reduce excessive inspections of entrepreneurs. The actions are to be presented by the Ministry of Economic Development and Digitalization by 9 September 2026.
