Moldovan Official Journal to publish way of recovery of days off for public sector employees on emergency state period

Chisinau, 4 June /MOLDPRES/ - The Official Journal (Monitorul Oficial) on 5 June will publish the way, established by the government, of recovery of the days declares days off by Moldova’s Commission for Emergency Situations on the period of the emergency state. Thus, the public sector employees will have to work 12 Saturday, with special working regime.   

Under the government decision, to recover 12 days declared days off, the following working days are established during 2020: 13 June, 27 June, 4 July, 18 July, 1 August, 15 August, 5 September, 19 September, 3 October, 17 October, 31 October and 14 November. On these days, the work of the employees with a normal duration of the working time will be organized according to the following work schedule: 8:00-16:30, with a dinner break on the period 12:00-12:30.  

The working time equivalent with another ten days off will be recovered starting from 1 July 2020, through increasing the daily working time by one hour on the period beginning from Monday till Friday and cutting the dinner break by 30 minutes. On the days starting from Monday till Friday, the daily working schedule is established as follows: from 8:00 till 17:30, with dinner break beginning with 12:30 till 13:00 in the public institutions/authorities subordinated to the government for the employees with normal duration of the working time; by the head of the entity for other public institutions and authorities.

The record of the days/hours needed to be recovered will be kept by the employer individually, for each wage earner, including on the employees who on the next period will ask for annual leave, paternal leave or unpaid leave or will have suspended labour relationships, including for reasons of disease or injury, till the full recovery of the days declared days off.  

These provisions do not apply to the employees who worked based on instructions by the Commission for Emergency Situations on the periods 30 March – 3 April, 7 April – 17 April, 21 April – 24 April and 27 April – 30 April 2020; were not in labour relations with the concerned unit; their individual labour contracts/labour relations were suspended; were on medical leave, paternal leave, annual leave, unpaid leave; carried out distance or office work under a decision by the employee.  

On the period 17 March – 15 May, when emergency state was declared in Moldova, caused by the need to prevent and combat the new-type coronavirus COVID-19, the Commission for Emergency Situations instructed forced vacations for more categories of public sector employees. In all, these employees stayed at home starting from 30 March till 30 April. They received their salaries, on condition that these working days will be recovered subsequently.
