The promulgation decree and the law amending the rules for establishing and managing homeowners’ associations in condominiums, which will introduce new signature and voting thresholds, have been published in the Official Journal and have entered into force.

Thus, to set up a homeowners’ association, the signature of at least half of the owners will be required in the case of associations that manage multiple condominiums, and at least one quarter of the owners for associations covering a single condominium. Currently, the legislation stipulates that five signatures are sufficient to establish an association.

In addition, for the election of the administrator, the members and the president of the council, as well as the audit committee, the votes of more than half of the total number of owners in the condominium will be required. The same threshold will apply to the approval of the association’s annual budget.

The new provisions also allow for the reorganization of existing structures, so that owners in associations managing several condominiums may decide to set up a separate association for their own building or residential complex, which will operate under the same legal conditions.
