Moldova's Superior Council of Prosecutors to have new activity regulation

The Superior Council of Prosecutors (CSP) will have a new activity regulation. The document, which is structured into 11 chapters, was approved at a today's meeting.

The document was presented by CSP member Aliona Nesterov, who said that the drafting process had been carried out in accordance with the present legislation.

The draft regulation was developed with the involvement of the Council members and representatives from the apparatus, and prosecutors were informed and consulted about the possibility of submitting proposals.

“Considering the complexity and number of necessary changes, it was decided to repeal the old regulation and adopt a new normative act structured into 11 chapters,” the cited source noted.

The first chapter addresses general provisions – legal framework, purposes and principles; Competencies of the Council – legal and administrative duties; Composition and competencies of the members – rights, obligations and responsibilities; Election and mandate of members – specific procedures and duties; Council meetings – organization, conduct, recording, and reasoning of decisions; Examining appeals – procedures for appeals and competitions; Secondment, suspension, and release of prosecutors – disciplinary and administrative regulations; Intermediate chapters – operational procedures and work of subordinate bodies; Final provisions – enforcement of regulation and harmonization with legislation.

According to the cited source, the regulation provides a clear and transparent framework for the Council's activity and CSP decisions can be appealed within three days after issuance, according to legal procedures.
