
Moldovan parliament makes major changes in inheritance legislation; law enters into force in 2026
The parliament of Moldova has voted, in the second reading, a draft that simplifies the procedures related to inheritance.
One of the most significant changes concerns the reintegration of the surviving spouse into the first class of legal heirs, meaning that they will be able to benefit, in addition to their share of the inheritance, from the furniture and household items in the common dwelling.
The law also introduces the possibility of the termination of heir’s rights, at the request of any interested person, if the court finds substantial reasons. If the court ruling occurs after the inheritance has been taken into possession, the concerned person will be required to return the goods, and his/her share will be redistributed among the other heirs.
Another important aspect of the reform is the simplification of procedures for accepting or renouncing an inheritance, extending the legal term from six to 12 months, thus giving heirs more time to take an informed decision.
The legislative amendments will come into effect on January 1, 2026.
