Evaluation Commission challenges decision of Superior Council of Magistracy on judge at Supreme Court of Justice of Moldova

The Judges’ Evaluation Commission today filed an appeal with the Supreme Court of Justice (CSJ) against the decision of the Superior Council of Magistracy (CSM) that rejected the re-evaluation report regarding judge Ion Bulhac of the Chișinău Court of Appeal, Centru seat.

Following the re-evaluation, Panel A upheld its initial conclusion, finding that the judge does not meet the ethical integrity criteria and recommending that he should not pass the external evaluation.

On 4 August 2026, the CSM rejected the re-evaluation report, essentially considering that the ethical aspects identified by the Commission do not reach the required level of gravity, or that certain circumstances reduce the judge’s degree of responsibility.

After receiving and examining the CSM’s reasoned decision, the Commission ruled to exercise its legal right to challenge it before the CSJ. In the Commission’s opinion, the CSM has departed from its previous practice and failed to carry out a cumulative assessment of the judge’s 16 rulings related to the six cases examined by the European Court of Human Rights (ECtHR).

The CSJ is to examine the appeal within 30 days from its filing.

In the case of judge Veronica Cupcea, acting president of the Orhei District Court, the Commission decided not to challenge the CSM decision of 4 August 2026.

For the year 2020, the CSM replaced the value of the Household Consumption Expenditure (HCE) for the urban environment with the one for the rural environment. Following this recalculation, the total amount of unexplained assets fell below the threshold set by law.

After examining the CSM’s reasoning, the Commission found that there had been insufficient legal grounds for filing an appeal to the CSJ.
