Prosecutors' vetting continues in Moldova: 70 files completed, 42 prosecutors pass evaluation

The Prosecutor Evaluation Commission informs that it has completed the procedure for assessing the ethical and financial integrity of 70 out of 190 notified subjects and candidates under Law No. 252/2023 and Law No. 26/2022. Forty-two prosecutors of them passed the evaluation, while 28 did not meet the legal criteria.

According to the Commission, under Law No. 252/2023, regarding prosecutors in office, 38 evaluation reports and three decisions to terminate the procedure were issued in cases where the subjects had already been evaluated under other legal acts. In total, 27 prosecutors received a recommendation to pass the external evaluation, while 11 were proposed for non-promotion.

As for the evaluation of candidates for the specialized boards, 32 decisions were issued. Fifteen of them passed the evaluation and 17 did not meet the ethical and financial integrity criteria. Of the 17 non-promotion decisions issued under Law No. 26/2022, 11 were appealed to the Supreme Court of Justice, all of which were rejected.

According to the data presented, at the Anticorruption Prosecutor’s Office, 33 prosecutors were evaluated, of whom 23 passed and 10 did not pass. Presently, 17 prosecutors are still undergoing evaluation and two are subject to a re-evaluation ordered by the Superior Council of Prosecutors (CSP). Ten prosecutors resigned within the legal 20-day period following notification, and one prosecutor could not be notified.

At the General Prosecutor’s Office, four prosecutors were evaluated; three passed the evaluation and one did not. Eight prosecutors are in the evaluation process and two have resigned.

At the Prosecutor’s Office for Combating Organized Crime and Special Causes (PCCOCS), one prosecutor passed the evaluation, while 15 prosecutors resigned within the legal period after notification. The procedure continues for another 63 subjects.

The Commission announces that it has sent 514 information requests and conducted 148 rounds of questions. In addition, 36 applications for extension of deadlines were submitted, and the evaluation files total 111,961 pages.

The evaluation process includes such stages as collecting and verifying information, requesting clarifications, holding public hearings and issuing the final report with a recommendation for promotion or non-promotion.
