Energy communities: clearer rules for establishment and registration

Chisinau, 23 September 2026 – The Committee on Economy, Budget and Finance will propose that Parliament consider the draft law on energy communities in first reading.

The draft law aims to create a clear regulatory framework to facilitate the establishment and registration of energy communities. This objective will be achieved by clearly defining in legislation the conditions for establishment, the categories of founders, the required documents, and the mandatory content of the statute.

This will ensure the direct and non-discriminatory participation of all categories of participants – individuals, local public administration authorities, municipal enterprises, homeowners’ associations in condominiums, as well as small and medium-sized enterprises.

According to the document, an energy community will take the form of a nonprofit association whose primary purpose is to create environmental, economic, or social benefits for its members and for the local area in which it operates. The proposed rules will also standardize and simplify establishment and registration procedures by expressly specifying the mandatory documents required for these processes.

The assets and income of energy communities will be used exclusively to achieve the objectives set out in their statutes. Any profit obtained from economic activities will not be distributed to members but will be reinvested in the development and operation of the community. The draft law facilitates the transfer for use by the community of immovable property and energy infrastructure owned by local public administration authorities, where these authorities have the status of community members.

The document was developed by the Ministry of Energy with the advisory support of the United Nations Development Programme in the Republic of Moldova, within the project - Resilient Communities through Women Empowerment, Phase 2, funded by Norway and Sweden.

Following its adoption, the draft law on energy communities will enter into force one month after its publication in the Official Journal. At the same time, legal entities that previously obtained the status of a renewable energy community or a citizens’ energy community will have 24 months to reorganize by transforming into energy communities regulated by the new law, with the full transfer of their rights and obligations.
